Terms & Conditions

These Terms and Conditions govern the sale of merchandise and tattoo services by Charmink Tattoo ("I" or "me") to you ("you" or "Client"). Please read these Terms and Conditions carefully before purchasing any merchandise or booking a tattoo appointment.

1. General Provisions

​

By accessing or using our website, purchasing merchandise, or booking a tattoo appointment, you agree to be bound by these Terms and Conditions. If you do not agree to all of the Terms and Conditions, you may not use our website, purchase merchandise, or book a tattoo appointment.

2. Tattoo Services

​

  • Age Requirement: The client must be at least 18 years old to get a tattoo from us. If the client are under 18 years old, you must have the written consent of a parent or legal guardian.

  • Medical Conditions: The client must disclose any medical conditions or allergies you have to us before getting a tattoo. I reserve the right to refuse to tattoo you if I believe it may be a health risk.

  • Consultations: The client can book offer free consultations to discuss your tattoo ideas. During the consultation, we will discuss your design, placement, size, and price.

  • Deposits: A deposit is required to book a tattoo appointment. The amount of the deposit will vary depending on the size and complexity of the tattoo. Deposits are non-refundable if you cancel your appointment within 24 hours.

  • Cancellation:  I understand that unforeseen circumstances may arise.

    • Cancellations made with at least 24 hours notice prior to your appointment will allow you to transfer your deposit to a new appointment date and time.

    • Cancellations made less than 24 hours notice will forfeit the deposit.

  • Rescheduling: The client is welcome to reschedule your appointment once, subject to availability.

    • Rescheduling must be made at least 24 hours prior to your original appointment time.

    • The client's deposit will be applied to the rescheduled appointment.

    • Multiple Reschedules: If the client needs to reschedule more than once, a new deposit will be required to secure the next appointment.

    • No-Shows: A no-show is considered a late cancellation and will result in the forfeiture of your deposit.

  • Payments: Payment for the tattoo is due at the time of the appointment.

  • Design on Day of Appointment: The design will be developed and presented to the Client on the day of the scheduled appointment. This allows for a collaborative and iterative design process where client feedback can be incorporated directly.

  • Design Ownership: By creating your tattoo design, I will retain ownership of the copyright to the design. The client must not reproduce, modify, or distribute the design without the artist's express written permission.

  • Touch-ups: I offer one free touch-up for the first month after your tattoo is completed. Additional touch-ups may be subject to a fee.

  • Revisions: Once a tattoo is started, I cannot guarantee that I will be able to make major changes to the design. Any revisions will be subject to the artist's approval and may be subject to an additional fee.

  • Appointment Time and Completion:

    • I understand that the estimated tattoo appointment time may vary depending on several factors, including the size and complexity of the design, and the need for breaks or late start.

    • If the tattoo takes longer than initially planned to complete due to these reasons, the artist reserves the right to propose another appointment to finish the tattoo.

    • The client may be asked  for an fee to cover the cost of the additional appointment time. This fee will be based on the artist's hourly rate and the estimated time needed to complete the tattoo.

    • The client has the right to accept or decline the proposed additional appointment. However, if the client declines, the tattoo will be considered unfinished, and no refunds will be provided for the deposit or the work completed thus far.

  • Healing: It is your responsibility to follow the proper aftercare instructions given by the artist. I am not responsible for any infections or other complications that result from improper aftercare.

  • Tattoo Cover: 

    • During your consultation, I will thoroughly discuss your desired cover-up design and assess the concealability of your existing tattoo. I will advise you on the likelihood of achieving full coverage and recommend alternative design elements if necessary.

    • Final approval of the cover-up design rests with the client. However, I reserve the right to decline designs that I believe are not suitable for effective cover-up.

    • I cannot guarantee complete concealment of your existing tattoo, especially in cases of dark or dense tattoos.

    • My guarantee applies only to the quality of our tattooing work, not the absolute invisibility of the original tattoo.

3. Merchandise Purchases

​

  • Products: I offer a variety of merchandise, including clothing, prints, accessories, and more. All merchandise is sold "as is" and without warranty of any kind, express or implied. I do not guarantee the accuracy of any product descriptions or images on our website.

  • Prices: Prices for merchandise are subject to change at any time without notice. I will make commercially reasonable efforts to ensure the accuracy of the prices listed on our website, but I cannot guarantee that they will be error-free.

  • Payment: I accept payment for merchandise by all major credit cards and debit cards. Payment is due at the time of purchase.

  • Shipping: I ship merchandise to addresses within [your country/region]. Shipping costs are calculated based on the weight and destination of your order. I will use commercially reasonable efforts to ship your order within [your turnaround time], but I cannot guarantee a specific delivery date.

  • Returns and Refunds: I accept returns of undamaged merchandise within [your return window] of purchase. You must obtain a return authorization number from us before returning any merchandise. Refunds will be issued for the purchase price of the merchandise, minus any shipping costs.

  • Intellectual Property: All content on our website, including product descriptions, designs, and images, is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or commercially exploit any of our content without our express written permission.

4. Disclaimer of Warranties

I DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANDISE AND TATTOO SERVICES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. I DO NOT WARRANT THAT THE MERCHANDISE OR TATTOO SERVICES WILL MEET YOUR NEEDS OR THAT THEY WILL BE ERROR-FREE OR UNINTERRUPTED.

5. Limitation of Liability

IN NO EVENT SHALL I BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE MERCHANDISE OR TATTOO SERVICES, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE MERCHANDISE OR TATTOO SERVICES.

6. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England. You agree that any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the courts of England, and you consent to the personal jurisdiction of such courts.

7. Dispute Resolution

​

In the event of any dispute arising out of or relating to these Terms and Conditions, you and we agree to attempt to resolve the dispute through good faith negotiation. If we are unable to resolve the dispute through negotiation, we agree to submit the dispute to binding arbitration in accordance with the rules of The London Court of International Arbitration. The arbitration will be conducted in London, and the award will be final and binding upon both parties.

8. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

9. Entire Agreement

​

These Terms and Conditions constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Amendment

​

We reserve the right to amend these Terms and Conditions at any time by posting the amended Terms and Conditions on our website. The amended Terms and Conditions will be effective immediately upon posting.
